I, Andrew Eaves, being of sound & disposing mind. I will that all my just debts & funeral expenses be paid. I will that my present property, money, notes which are not named in the following items of this will, to be equally divided among my daughters, Elizabeth HILL, Guilford & SPENCER EAVES. I give to my daughter ELIZABETH HILL the tract on which I now live and at her death to my sons GUILFORD & SPENCER EAVES. I give unto my son GUILFORD the tract of land he now lives on containing 400 acres. Provided no suit is ever brought against me by LAWSON P. EAVES (son of LAWSON EAVES, decd.) or by others, concerning his father’s estate on which I was Admnr. and because of my ignorance of the law may not have been discharged in strict accordance of the law. I give unto my son GUILFORD a Negro named Moses and $900.00. I give daughter ELIZABETH, Negroes Dan & Mariah. My son SPENCER a house and lot in Rutherfordton, I give unto my son Negroes, Wilson & Mira. I give unto my grandchildren, the children of my deceased daughter, CATHERINE SULLINS, who may be alive at my death $100.00 each. I appoint my son SPENCER EAVES my executor. Witnesses: E.
